Working To Get Something We Need Passed In The U.S. Senate

By:  Doug Busselman, Executive Vice President

While I appreciate reading about Washington, D.C. forecast of this type , which offers the perspective (and hopefully accurate projection) that bad legislation will not be successful in gaining passage in the U.S. Senate and I harbor some belief that it is quite possible nothing will be passed by the U.S. Senate – there is a very major issue that does need attention…passage of some type of legislation to deal with the expiring Death Tax law.  Unless something is passed in the U.S. Senate and a completed fix accomplished with both bodies of Congress and a signature by President Obama – the Death Tax snaps back to the provisions that were in place in 2001 ($1 Million per person exemption and a top rate of 55 percent).

Those working on the issue in Washington, D.C. tell us that there is something in the works with members of the Senate Finance Committee paying some attention to the matter with a possibility of a committee mark-up coming after the Memorial Day recess.  How that translates into a meaningful legislative effort that carries through the process, as necessary, remains as uncertain as everything else involving the U.S. Senate right now.

There is some consideration being given to a solution with a $5 Million exemption and a lower rate (perhaps something like 35 percent), but until and unless there is movement of a specific bill it is a challenge to predict what might get traction.  Family-owned business enterprises, especially farms and ranches, need the relief that even this approach would provide.

Nevada’s two U.S. Senators need to hear from the people of Nevada on how critical this matter is.  Perhaps by those impacted, sharing their stories, we can persuade actions which result in the way Death Taxes prey on those seeking to maintain profitable small business operations from one generation to the next.  We invite you to share your comments here, but also hope that you’ll make every effort to let Senator Reid and Senator Ensign know how critical their activity on dealing with the Death Tax will be…
